In the eyes of the federal government, marijuana cultivation, distribution, and consumption is almost always against the law. However, approximately 33 states across the US have amended their laws to legalize medical marijuana. To date, 11 states and the District of Columbia have legalized cannabis for recreational use for adults over the age of 21. Nevada is one of them.
On November 7, 2000, Nevada became one of the first states to legalize marijuana for medicinal purposes. Patients with chronic or debilitating conditions who wished to obtain a medical marijuana card that enabled them to possess or use marijuana may now submit an application to the Nevada Division of Public and Behavioral Health
The legalization of medical marijuana was a massive step that likely inspired the plant’s legalization in a multitude of other states. However, there were strings attached.
When Nevada passed legislation authorizing medical marijuana establishments in the state in 2013, the list of guidelines and regulations governing patients, cultivators, and distributors were exhaustive. Confusion over the laws caused many people to face prosecution. Despite the hurdles, however, many cannabis entrepreneurs opened up shop in Nevada and patients continued to treat their conditions.
In 2016, Nevada passed the Regulation and Taxation of Marijuana Act. Under the act, Nevada declared that cannabis should be treated less like an illegal drug and more like alcohol. In January 2017, recreational use of marijuana and its alternate forms (edibles and capsules) became legal for people 21 and older. Although adults no longer need medical approval to consume marijuana in Nevada, restrictions remain for users as well as cannabis establishments, and they are likely to continue to change.
