Does Your Nevada Property Have Construction Defects?

In many cases, construction defects are apparent right away. These are known as patent defects, and are typically surface-level issues that are discovered during normal inspections. Latent defects, however, are generally not readily observable and often don’t become apparent until months, or even years have passed.

Our attorneys handle a variety of cases involving design, material, and workmanship defects that impact the stability, functionality, and safety of your property. Whether your construction defect was discovered prior to the project’s completion, when ownership was transferred, or years down the road, we can help.

FAQs

What is a construction defect?

A deficiency in the design, workmanship, or materials that leads to structure failure and/or causes damage to the building or property or injuries to a person is commonly referred to as a construction defect.

What are common construction defects in Nevada?

- Cracked slabs or foundations
- Defective stucco

What damages are recoverable in a construction defects case?

Depending on the legal theories pursued, plaintiffs may be entitled to:
- Actual and compensatory damages. These may include the cost of repairing the building itself as well as the cost to repair or replace the building’s contents that were damaged by the defect.
- Expert fees, appraisal fees, storage costs, and cleaning/restoration costs can generally be recovered.
- Compensation for the reasonable cost of similar housing if the building was uninhabitable.

If serious construction defects exist that the builder can’t, or won’t repair, Maddox, Segerblom & Canepa can help you recover your losses by filing a claim or taking legal action.

The law firm of Maddox, Segerblom, and Canepa were amazing to work with. They were through and always available for any questions we had. We worked a lot with Sandy who was always professional, friendly, always on time for appointments and just a great person to represent this firm. We have never been involved in a lawsuit before and they made it comfortable for us. We appreciate the hard work the lawyers and people who work for the firm did and would recommend them.

I owned a Clayton Manufactured home out in Red Rock, which I loved, and did not realize I had boundary and septic troubles until I decided to sell it. Because of Ardea Canepa's sharp eye and very firm letter to the sub contractor I recovered ALL my expenses and have settled all the issues. I am absolutely amazed what Ms Canepa achieved with one letter that I could not resolve in many letters!. I can and will recommend Ms Canepa and her firm very highly when land issues arise.
Thanks to Ms Canepa for her expertise and professionalism!
